The cost to probate or administer an estate in Alberta does not have to be over-the-top expensive, at least not with us.  We do not take a percentage of the whole estate when you hire us to do the core application work.  Our services and fees are set out below.

Although we have made our fees remarkably affordable for Alberta families; in no way has it ever jeopardize the quality of our work.

Let By-Your-Side Probate Services prepare your application for the grant you need to administer an estate with or without a will.  We are well known for our efficient, affordable services.  It will allow you to file your application with the clerk of the court hassle-free within one to three weeks.

Phase I

Non-Grant Application

2 payments required - First half to be paid up-front.  the second half to be paid in full prior to filing the application at the courthouse.

Since the new Estate Administration Act was updated Executors are mandated to have the Non-Grant Application prepared if banks, land titles and or other institutions waive the requirement to file an application with the Clerk of the Court, in Alberta.  The Non-Grant Application is for the benefit of the beneficiaries and they should be able to expect this work completed by the executor.  (call us to prepare the non-grant application)


Phase I
(this service is only for executors who have purchased the application forms and know how to fill the forms out on their own.  Or for executor's who have had their work bounced back and require amendments made to their application work.)


Proofreading the executors 1st draft of application and making amendments, prior to it having been filed with any clerk of the court.

Proofreading and making adjustments to the rejected application from the court that the executor's prepared and filed with the clerk of the court. 
$250. + 120/hour
Up-Front fee (to secure our services)

Thereafter - any additional hours worked on the application will be billed $120/hour for a final invoice to be paid prior to the executor filing the application work at the courthouse.

Inquire about this hourly rate.  Typically it takes a minimum of 1 to 4 working hours to complete the proofreading when the majority of the work has been done correctly by the executor.  But not necessarily in one day, as it can take the executor of an estate some time to gather-in all information required.

Phase I

Supplementary Affidavit

This is a one-time upfront fee to secure our services.
$375.00

There can be times when executors or administrators do not have access to all information on assets and debts owned by an estate until after the Justice of the Court issues a certified grant in the meantime.  Although it is not the ideal situation, it is important for executors to carry out their fiduciary duties regardless and it may become necessary to have us prepare a Supplemental Affidavit on your behalf.  It is OK to update the inventory of property and debt for the estate in this way.  As your probate coach, we ensure that you can file this supplemental affidavit with a clerk of the court when applicable and without delay from us.  


Phase II

Beneficiary Release Forms

This is a one-time upfront fee to secure our services.
$350.00


For an executor to be released correctly from their duties, it is expected that beneficiary releases along with financial documents, and if applicable executor's compensation statement be prepared for the beneficiaries to review and consent to prior to the inheritance being distributed.  This is an important last step to protect the executor and avoid creating discord with the beneficiaries or having the estate accounting contested.


Phase I and/or Phase III
Some executors require us to probate in AB but also reseal in another Province.

Resealing of a grant

2 payments required - First half to be paid up-front.  the second half to be paid in full prior to filing the application at the courthouse.

At times an estate may own property in Alberta and outside the province, and even outside Canada.  It is likely that an application for resealing a grant is required.  Presently we prepare resealing applications for Alberta and British Columbia.

When filing your application work, the clerk of the court bills separately from us and the executor must pay them a one-time fee before receiving the certified grant from a Justice of the Court.  These fees do not reflect our services or our own fees, in any way.  (Inquire as to how much your filing fees at the courthouse will be across Alberta.)
